New Home Affairs directive waives the 60-day submission requirement!


On 02 October 2026, Dr Leon Schreiber, Minister of Department of Home Affairs, issued Directive 13 of 2026 - a much-needed blanket directive waiving the 60-day submission requirement. The Department decided to grant the waiver in respect of all visa applications for extension or change of status / conditions which are still pending adjudication as well as all pending appeal applications which were submitted for reason that the visa extension or change applications were not submitted at least 60 days prior to the visa expiry date. The department also extends the waiver to all future applications to be submitted within South Africa and to be adjudicated by the Department of Home Affairs. Previously, and by law as per Section 10 (7) of the Act and Regulation 9(5)(a), all visa applications submitted within the Republic needed to be submitted, in person and by appointment, no less than 60 days prior to the expiry of the existing visa. Very important - this blanket waiver is ONLY granted on condition that the visa application shall be submitted whilst the existing visa is still valid. No applications without a valid visa will be accepted. The contents of the directive have been brought under the strict attention of all officials concerned.
